Consumer Health Data Privacy Policy

Some state laws treat images of a person’s face and body as consumer health data. This policy explains how we handle that data for anyone who books a photography session directly with Capturely. If your employer, school, or another organization arranged your session, its agreement with us and our main Privacy Policy at capturely.com/privacy-policy govern instead.
What we collect and why
- Photographs and video of you captured during your session, and the edited images we deliver. Purpose: to produce and deliver your images.
- Session recordings, where a session is recorded. Purpose: quality review, support, and safety.
- The name, email address, and mobile number you give us. Purpose: to book your session, deliver your images, and support you.
We do not collect health conditions, diagnoses, treatment, reproductive or gender affirming care information, precise location, or biometric identifiers. Our software locates your face for a moment to focus and crop; it does not create or store a face template and does not use facial recognition.
Optional uses (improving our AI, showing your image in our marketing, sending you marketing messages) happen only if you check a separate box, and you can withdraw any of them at hello@capturely.com.

What we share and with whom
- Your images, recordings, and booking details are shared with the service providers that host, schedule, edit, deliver, and support your session. Their categories (cloud hosting, scheduling, image editing, messaging, payments, analytics) and names are listed at capturely.com/subprocessors. Each is under a written contract limiting its use to our service.
- Your images and booking details are shared with authorities when the law requires.
- We do not sell consumer health data, and we do not share it for advertising. We have no affiliates.
How to exercise your rights
Email hello@capturely.com to access, delete, or withdraw consent for your consumer health data. We verify your identity and respond within 45 days. If we decline any part of a request, we will say why, and you may appeal by replying to our response. If your appeal is denied, we will tell you how to contact your state attorney general.
